Barbara's Story

I am retired living if South Carolina it's a great place to retire, I miss family and friends. I became an volunteer environmental advocate when a local oil company in Marcus Hook refused to honor Access Agreements and conduct Act II clean up and removal of toxic soil they left under 2205 and 2207 W. 11th Street Chester Township, PA following a spill as owner of the property the spill occurred. Their agent admitted not testing any soil in the basements of the homes the oil migrated and knowing the carbons in fuel oil cause leukemia a form of cancer, yet the environmental health and safety of residents is obviously not a concern of this oil company. I wonder how many residents will have to die in these homes before Chester Township officials demand the oil company honor 2001 Access and Indemnity Agreements by conducting Act II testing, remediation and removal of toxic soil under the basements of these homes and acquired a release from PADEP as they agreed to do, but did not. Legislation is needed to protect the rights of residential owners and residents/tenants following an oil spill as it protects the water ways, the forest and animals can you help?. It is criminal to require residents fight a billion dollar oil company when tax payers are paying EPA over Five Billion Dollars a year to protect our environmental health and safety. The state of Pennsylvania has very weak environmental laws and extremely poor enforcement with little or no protection for home owners. Is it because Philadelphia is the home of this oil company? any soil in the basement of these properties despite six years of litigation with numerous continuances granted the oil company as they pretended to test. It was as if they owned the court. It was heart breaking to watch oil money shut down the Justice System/the courts for minority oil spill site owners. Those with the power to help ignore violations of residents environmental health and safety and laws and fines due the government for refusal to report, test and remediate the soil under homes in accord to PADEP rules and regulations for over 8 years as they agreed to do. No one is concerned about the cancer causing chemical left in the soil under these homes, I guess no one from their family or friends have been affected. The September 11, 2009 Summary Judgment granted the Defendant Sunoco, Inc. and it¿s agent Mulry & Cresswell Environmental in Delaware County courts without any proof of their innocence while not allowing proof of their guilt due to a Gag Order granted when I the Plaintiff Harris ran out of money to continue to fly to PA to watch Sunoco refuse to test the toxic soil under the homes for over 8 years of flights to watch bogus environmental test which failed to meet PADEP requirements for testing.. These illegal activities won their freedom to walk away from fraud and destruction of homes and lives. A sad note for Justice when I could not get an Arbitration or Trial due to six years of continuances.
