He does not subscribe to a capricious, whimsical approach to jurisprudence; on the contrary, he argues that the accumulated wisdom and scientific evidence and the social mores it affects should be incorporated into the fabric of the Constitution itself as we learn more of the natural world as well as ourselves. Without such malleability and transparency, how could we have abolished slavery from ALL states of the Union, allowed ALL women the right to vote and own land, protect all citizens--even those who were largely considered and mistreated as 2nd-class citizens (or worse)--regardless of ethnic origin or religious preference, etc. Now, as scientific evidence continues to accumulate and support the medical and physiological notion that ones sexual orientation is pre-determined by chemical combinations and hormone levels that occur in utero, or long before one is born. Perhaps soon, as fewer and fewer Americans view homosexuality as a civic sin or sign of moral weakness or poor religious upbringing, the Civil Rights Act will expand to include people--roughly 9%-11% of men, 5%-6% of women--who identify themselves as homosexuals, ie, it is NOT a choice except for rednecks and the otherwise willfully stupid who demand to the right to show the world just how stupid people can be toward others.".
