On the day she was supposed to testify, my public pretender sent her home without consulting with me. When I learned about it, I should have asked for a mistrial. He claimed the taped recording of her 911 phone call to the police would be enough to win me an acquital.
Despite all this, when the jury brought back a guilty verdict, they had added their own handwritten appendage to the verdict form stating; "with the recommendation of leniency due to the unpremeditated nature of the act" .
What jury is going to recommend leniency for a man they believed knowingly and intentionally shot a police officer after he identified himself? Moreover, how could it be "unpremeditated" if as the state alleged I ran to the back, and retrieved my gun and shot the officer after he identified himself?
Despite, the jury's recommendation, the judge gave me the maximum sentence of 50 years. I did a month and a half short of 25 years. So if I seem to be a little rough around the edges, please take into consideration where I've been, and the hard life I've been forced to live. Where death lurks around every corner, and almost everyone is coming at you with some kind of game. Give me some time to adjust! Who knows? With polish I may turn out to be a diamond in the rough!".
