john's Story

During my tenure as a law student at Tulane, I worked at Pellerin Milnor in Kenner LA and the US Attorney's Office in New Orleans respectively. I met my wife, Martha, in New Orleans on a river boat during Mardi Gras. She is a Colombian National - who worked as a P.T. at Charity Hospital. We were married in 1982. We have 2 adult children - and are still happily married - living in Charleston, WV - where I was born and raised. After graduation I returned to W.Va. to attend to my mother who was gravely ill and who soon succumbed to the illness. I got a job as an assistant prosecutor in Kanawha County WVa. - which I held for 5 years, until I resigned. In 1988 I left the Prosecutor's Office to go into private practice, primarily in criminal defense - state and federal. During this time, I also worked as a hearing examiner for the WV Workers' Compensation Division - in addition to a legislative draftsman for the WV Legislature - advising members thereof and drafting legislation. In 1991 I became a WV Assistant Attorney General in the Division of Higher Education. In 1994 I reentered private practice. In 2007 I was appointed to a six year term to the West Virginia Court of Claims as a Judge - and, later, Presiding Judge. The WV Court of Claims hears claims brought against the State that would, otherwise, be immune from judgment under the concept of sovereign immunity. The Court also hears claims made by crime victims under the WV State Crime Victims' Act. I resigned in January 2011, before my term expired, to accept an appointment from the Governor of WV to act as the Director of a newly created State governmental agency, i.e., the Office of Administrative Hearings (OAH) under the authority of the WV Department of Transportation. . In 2011, I was appointed as the first "Chief H...Expand for more
earing Examiner and Director" of the newly created OAH by then Governor Joe Manchin (now a US Senator), where I continue to serve. OAH was created to handle contested license revocations issued by the WV Division of Motor Vehicles, for the most part premised on alleged DUIs. I am a member of the W. V. and LA. State Bars as well as the United States District Court for the Southern District of WV, the U.S. Court of Appeals for the 4th Circuit Court and FINRA (Financial Industry Regulatory Agency) - as a certified arbitrator. I remember Professor Joel Freidman, Professor Catherine Hancock, Professor McDougal (Property) and Professor Barron (labor law) with respect - as being good instructors. Prof. Strickler, who taught contracts - told me during my first semester, in essence, I should consider quitting law school "as some people are not cut out to be lawyers." The funny thing is - he gave me a D on my final contracts exam - yet I was 1 of 2 students with the highest grade on a mid term that didn't count. I also remember Professor Kapra - or, perhaps "Kappra," who, at the time, was a boy genius instructor who graduated number 1 from Berkley Law School - - all the students had hand-held cassette tape recorders because his verbal instructions were in near real time with his mind. I had him for federal civiil procedure. While I didn't graduate with accolades - I was in the upper half. Martindale Hubbell rates my ethical standards and legal ability very high. I have never, since the inception of my legal career (i.e., since 1982), been found to be ethically or negligently wanting. I am close to retirement (3 years), and my wife and I plan to return to New Orleans for retirement. I look forward to dining again at "Ye Olde College Inn" and "Mandinas." I hope I hear from the Law School.
